POLICIES, TERMS, CONDITIONS

If you use our service, you agree to and agree to follow, be bound by ,and abide by these POLICIES,TERMS AND CONDITIONS:


1. ANY/ALL RENTAL FEES IF SHOWN ARE FOR TIMEFRAME UP TO 1 HOUR (60 minutes) unless otherwise specified. We can stay longer than 1 HR (60 minutes)  if desired and for an extra fee and is dependent on availability.  An extra HOUR is equivalent to another party slot and will be billed as such (without a 2nd travel fee if there was one) . If you book any amount of time or any package of ponies but decide either before we arrive or once we are there that you want us to leave early or not use as many ponies, WE STILL GET PAID AND KEEP THE ORIGINAL FULL AMOUNT ON THE INVOICE. NO REDUCTIVE CHANGES ON PACKAGES OR PRICE WILL BE ALLOWED TO BE MADE THE DAY BEFORE, THE DAY OF THE EVENT OR ONCE WE ARE ON THE LOCATION. 


2. The Host or Hostess of the event ( the client and/or the person, business, company or entity who made the reservation, paid the retainer and/or contracted our services ) agrees to take all responsibility and liability for anything and everything that may happen as a result of any of their guests or anyone on the location interacting with us or our ponies. It is made plain and understood here that interacting with equines or animals of any kind is an "INHERENT RISK ACTIVITY" meaning that it is still an animal and no matter how well trained the animal, or how many precautions are taken it is impossible to eliminate all risk of injury or adverse events. Therefore, the person or entity who contracted our services agrees to assume all responsibility for anything that may happen and further agrees to  hold us (Pretty Pony Parties and all people, agents, or entities related or connected to us) harmless and indemnify us in the event that anything, including but not limited to, any loss, harm, adverse event, or injury of any type that may happen or does happen to anyone who interacts with any of our equipment, agents or animals while we are at their location or the location they asked us to perform services for them at. The Client also agrees that it is their responsibility to inform the parents of the children and any other guests at their event that Equine related activities are "INHERENT RISK ACTIVITIES" and that if any guest participates, the guest individually or the parents that allow their children to participate are accepting the sole responsibility for any and all liability and that we (Pretty Pony Parties, and our owners or agents ) are indemnified and will not be held responsible for anything that may happen as a result of their choosing to participate or allow their children to participate with our agents, equipment or animals.


3. We ARE Entertainment. We ARE NOT BABYSITTERS. Our handler/s are there to handle, manage and supervise the pony and to guide the pony during rides, clean up behind the pony and etc. Parents are responsible for supervising the children and for the children's health and safety. We DO NOT take responsibility for any of the children or their supervision whatsoever. We do our best and strive for the most fun and safe time for all people (and our animals) involved while we are at your event but it must be understood that anything to do with interacting with equines (or animals) is considered an "INHERENT RISK ACTIVITY" and by allowing your child (or the child or children you are responsible for) to interact with and/or ride the ponies YOU ARE ASSUMING FULL RESPONSIBILITY FOR ANYTHING AND EVERYTHING THAT MAY OCCUR, or does occur, to you or the child. (including but not limited to: getting stepped on, nipped, falling off etc.)  Each parent (Or a person the parent or party organizer designates) will be responsible for the safety of each child and putting each child on the pony, walking beside the pony while the child is on the pony and taking each child off the pony. We can provide extra handlers to help with the rides if requested but it is an extra fee and does not in any way, shape, or form, or to any degree change or negate the parent's, client's or party organizer's responsibility for and over themselves individually, their guests,  any and/or all the children. NUMBER ONE RULE NEVER RUN UP BEHIND OR STAND BEHIND ANY HORSE PONY OR EQUINE. Our ponies are very gentle and have never kicked anyone but ALL PONIES AND HORSES ARE CAPABLE OF DOING IT AND AS A MATTER OF SAFETY YOU SHOULD SUPERVISE YOUR CHILD AND KEEP THEM FROM BEHIND THE ANIMAL. Many times we will tell children "Please don't stand behind the pony, please stay out from behind the pony" and they still don't listen. Either from disobedience or excitement. It is your responsibility as the parent or gaurdian to make sure your child stays out from behind the pony for general safety.  Also besides the safety or responsibility aspect please keep in mind we strive to make this an awesome and even "magical" experience for your child and we want you to be part of the experience and share a beautiful moment with your child and make a happy memory together! 

4. NON REFUNDABLE and NON TRANSFERRABLE RETAINER of at least $75 or more per pony required at time reservation is made to finalize reservation. (for larger packages, multiple pony and /or custom pony packages, holiday packages, and outside service area packages the Non Refundable/Non Transferable Retainer is higher depending on relevant factors but will not exceed 30% of the total price). Once a date/ time slot is booked and retainer paid, if you want to reschedule THAT RETAINER IS NOT TRANSFERRABLE. If you want to either change the time on the same day (subject to availability) or book a different day and time(subject to availability):  you forfeit the retainer for the current spot and must pay the retainer for the new slot. NO REFUNDS WILL BE GIVEN ON ANY MONIES PAID for retainer. If you pay in full upfront we will apply the amount exceeding 30% to the new reservation slot. We only have a limited number of slots and we are detrimentally relying on you to keep your reservation (this means we turned away other interested parties in order to keep our word to come to your event and if/when you cancel or change you are causing us to lose money due to all the people we could have given the slot to but turned away)


5. NO CHANGES can be made within 7 days of event. We usually contact you as a courtesy the day before your scheduled reservation to confirm all details of your rental, confirm you still want your rental and get payment or payment arrangement. IT IS YOUR RESPONSIBILITY TO KEEP US UPDATED WITH YOUR NEW NUMBER OR CONTACT INFO IF YOU CHANGE NUMBERS/EMAIL ETC .

IF YOU HAVE NOT HEARD FROM US BY 1PM THE FRIDAY BEFORE YOUR PARTY IT IS YOUR RESPONSIBILITY TO REACH OUT TO US BEFORE 6PM TO CONFIRM (OR 6PM THE WEEKDAY BEFORE IF IT IS A WEEKDAY PARTY) AND TO PAY THE BALANCE BY THAT SAME TIME (6PM).

If we attempt to contact you (via text , phone, or email) to get confirmation and you either don't respond or we can't reach you and do not hear back from you by 6pm the Friday before your scheduled event, We will have no choice but to believe you no longer want the reservation, and It will be considered a CUSTOMER CANCELLATION. (Exceptions to this may be made at our discretion if the balance was Paid in Full at the time the reservation was made.)

Additionally, whether or not you hear from us by 1PM the Friday before your event (or the day before if the event is on a weekday),  it is still Your (the Client's) responsibility to pay the invoice in full by 6PM the Friday before your event (or 6pm the day before the event if the event is on a weekday). If the balance is not paid in full by the aforementioned time, it will be considered as CUSTOMER CANCELATION. In these cases, the retainer is forfeited by the client and we will not bring the ponies out.

To Be CLEAR: if for ANY REASON the Client has not paid the remaining balance in full by 6pm the Friday before the party (or 6pm the day before if the party is on a weekday) then it will be considered a CUSTOMER CANCELATION.  We won't show up.


6. Balance of total must  be paid by PAYPAL or DEBIT/ CREDIT CARD, OR CASHAPP by 6pm the FRIDAY before the party.  If needed other payment arrangements may be able to be made in certain cases.  In these cases where payment arrangements needs to be arranged it must be discussed and arrangements made by 6pm the Friday before the party if it is a weekend party, or by 6pm the day before the party if it is a weekday party . IF balance is to be paid paypal or card OR Cash App then the payment is due IN FULL by 6PM THE FRIDAY BEFORE your scheduled  reservation if your reservation is on a Saturday or Sunday. (OR by 6pm the DAY BEFORE your event if event is on a weekday). If payment arrangements for cash on arrival has been discussed and agreed upon by both us and the client, then the cash  is due ON OUR ARRIVALAND BEFORE WE START, NOT AT THE END. If you do not follow this policy and force our handler to wait for payment (such as you saying you have to go to the atm or bank to get the funds) or you pay by paypal or card the day of event (and then  handler has to try to contact someone who has access to the business account to verify the payment) The handler will not start rides until the balance is paid in full (and/or verified paid in full) and once balance is paid in full the handler will start giving rides and give rides for the rest of your scheduled time. If for some reason this is not followed and you force the handler to wait for payment but your scheduled time is up (and thus possibly make the ponies late to our next engagement) you will have to pay us extra for waiting $100 overtime fee for every pony on our trailer for every 30 minute block of time we have to wait.  WE DO NOT ACCEPT CHECKS OR MONEY ORDERS EVER.


7. Force De Majuere (Act of God) / Hurricane /Severe Weather Event/ Explosions/Road Collapse/Shelter In Place/Pandemic /Terrorist Attacks / Forced Shutdowns / Forced Evacuations /RIOTS/ Forced Closures etc... for situations either out of our control or considered "Acts of God" or any or all of (but not limited to) the aforementioned causes we may be forced not to show up to the party; in the event of any or all such situations outside of both our's and/or the client's control the RETAINER and /OR ALL MONEY ALREADY PAID even up to Amounts PAID IN FULL remain NON REFUNDABLE.  In such situations where we are able to and to our best ability and availability and at our sole discretion as a COURTESY we may reach out and give clients whose Parties were effected by circumstances such as these an opportunity to reschedule for a future date within up to a year from the originally scheduled date and have a credit applied to the future date. IN ANY and ALL of these types of circumstances if : A. we are unable to offer reschedule or B. the client is unable or unwilling to reschedule or C. there is any other circumstances or situation that prevents reschedule the money already paid to us  remains NON REFUNDABLE and NON TRANSFERABLE and is forfeited by the client.


8. We show up rain or shine, unless you cancel or there is an official weather advisory or Proclamation by Officials "Stay Home Not Safe To Drive"  ( Such as but not limited to: Hurricane, Flooding, Closed Roads, Riots, Civil Unrest ect as outlined in section 7 above) If you think you may desire to cancel because of expected inclement weather, or dangerous conditions, Please do so NO LATER THAN 48 HOURS BEFORE the event, or you will still owe us the full amount. IF YOU CANCEL AT ANY TIME: NO REFUNDS WILL BE GIVEN ON ANY MONIES ALREADY PAID.


9  If any "last minute" bookings (reservations made within 4 days of event date) are accepted they may be charged a slightly higher rate starting at 25% more and going up depending on how last minute it is.  (more for certain occassions such as holidays and high demand dates/times) 


10. IF any Rates are listed on this site they are our current normal rates inside our Normal Service Area for regular days. Holidays, Holiday Weekends and certain other days are higher rates. (Not due to higher demand but due paying our handlers a higher rate due to making our handlers take time from spending the holiday with their own family and loved ones.) And areas outside Beltway 8 do have travel fees. Rates vary depending on multiple factors such as type of pony, number of ponies,  the location and date. Please contact us to get an accurate qoute on price and availability. Qoutes are valid for 72 hrs after given. If a person does not make the reservation within 72 hrs we can no longer gaurantee that price. PRICES VARY AND ARE SUBJECT TO CHANGE. POLICIES TERMS AND CONDITIONS ARE ALSO SUBJECT TO CHANGE AT ANY TIME AND AT OUR SOLE DISCRETION.


11. 1 RIDER AT A TIME ONLY.  RIDER WEIGHT LIMIT 55 POUNDS. ONLY 1 RIDER AT A TIME PERMITTED. For the health and safety of our ponies : we reserve the right to tell any child they can not ride for ANY reason including being over the weight limit (we prefer you tell them before hand so they do not feel hurt or embarrassed) thank you for understanding as we are the #1 advocates for our ponies health, comfort, and safety. Also please be aware if you or one of your party guests forcefully demand or put a child on one of our ponies after we already told you that child can not ride or  told you that child is over the weight limit YOUR RENTAL ENDS IMMEDIATELY, NO REFUND AND YOU will be responsible for paying the vet bill, therapy/rehabilitation bill, money lost due to Parties we have to cancel from that pony being injured/unable to perform, and/or replacement cost for a new pony if our pony is injured and must be replaced due to you or your guests refusing to follow our guidelines.


12. NO DOGS OR OTHER PETS OF ANY KIND AROUND OUR PONIES. For the health, safety, and comfort of the ponies, the dog/pets, and children riders. No matter the size of the dog or pet. All dogs must be put up or restrained safely away from our ponies while we are at your location. Many dogs, especially those who have never seen a pony, will get aggressive towards ponies, trying to chase them, attack their neck or back legs or belly, which will cause the pony distress and possible harm and cause the pony to spook, act out, fight back, try to run, or kick to defend itself. We will not be held responsible if your pet or any person at your party gets kicked or injured due to your failure to abide by this rule and the behavior of your dog or any dog or animal that causes such problems. If our pony is injured you will be responsible for any and all vet bills and therapy or rehabilitation bills and/or an amount equal to the replacement cost of the pony if the pony is injured or must be taken out of service or put down due to it's injuries. ALSO NO OTHER HORSES OR PONIES AROUND OUR PONIES. If you are having a "petting zoo" come to your event as well, please ensure they do not bring a pony for the health and safety of our ponies and theirs. Thank you.
